1. Acceptance and Binding Agreement
By accessing, registering for, purchasing from or using NEXGEN Gallery, you agree to these Terms, the Privacy Policy, Disclaimer Policy and other policies linked from the service. If you do not agree, do not use the service.
Your use must comply with all laws applicable to you and to the content, website or activity concerned.
2. Eligibility, Legal Capacity and Mature Use
You must be at least 18 years old and legally competent to enter into a binding agreement to create or use an account. By using the service, you represent that you satisfy these requirements.
You are expected to exercise mature, lawful judgment. An account holder is responsible for activity performed through that account, subject to rights and remedies that cannot lawfully be excluded.
3. Nature of the Service
NEXGEN Gallery provides technology for theme discovery, upload, WebCopy, conversion, personalization, preview, editing, sharing and related functions. It is a tool and hosting/processing environment; it does not certify that a user's source material, generated output, copied website or intended use is lawful, licensed, accurate or suitable for publication.
Automated or Smart Processing does not constitute legal clearance, copyright clearance, content approval or professional advice.
4. User Content and Sole Responsibility for Use
You are responsible for the content and instructions you submit and for the websites, themes, images, videos, text, logos, code, business information and other material you upload, copy, generate, modify, download, publish or share using NEXGEN Gallery.
You must independently verify that you have all permissions, licences, consents and legal authority required for your use. You must also review generated or converted output before publishing or deploying it.
5. Copyright, Intellectual Property and Copying Themes
WebCopy, theme import and similar functionality do not transfer ownership or grant a licence to third-party websites, themes, code, photographs, videos, logos, trademarks, fonts or other intellectual property.
You must not copy, upload, reproduce, modify, distribute or commercially exploit material unless you own it, have permission or licence to use it, or your use is otherwise permitted by applicable law. You are responsible for claims arising from material you copy from another source or upload without adequate rights.
NEXGEN Gallery may remove or restrict access to allegedly infringing material and may preserve information where reasonably required for legal compliance, dispute handling or enforcement.
6. NSFW, Obscene, Harmful and Unlawful Material
NEXGEN Gallery does not authorize use of the service to create, upload, host, copy, convert, publish or distribute unlawful NSFW, obscene, sexually exploitative, child sexual abuse or exploitation material, non-consensual intimate imagery, unlawful pornography, or other content prohibited by applicable law.
The user remains responsible for content the user chooses to submit or create. To the maximum extent permitted by law, NEXGEN Gallery is not responsible merely because its general-purpose technology is misused to produce or process prohibited material. This does not limit any responsibility that applicable law does not permit us to exclude.
7. Strictly Prohibited Activities
You must not use NEXGEN Gallery for activity that is unlawful, fraudulent, deceptive, defamatory, threatening, harassing, privacy-invasive, malicious or infringing, or that facilitates crime or unauthorized access.
- malware, phishing, credential theft, impersonation, fraud or deceptive websites;
- content belonging to another person when you have no right to use it;
- copyright, trademark, patent or other proprietary-right infringement;
- content harmful to children or involving sexual exploitation or abuse;
- unlawful obscene, pornographic or non-consensual intimate material;
- money laundering, unlawful gambling, trafficking or other criminal activity;
- material that unlawfully threatens India's sovereignty, integrity, defence, security, friendly relations with foreign States or public order, or unlawfully incites a cognisable offence;
- circumventing platform security, attacking systems, distributing malicious code or abusing shared resources.
8. Moderation, Removal, Preservation and Cooperation
We may use technical controls, review reported material, suspend processing, restrict access, remove content or accounts, preserve relevant records and cooperate with lawful orders or competent authorities where required or permitted by applicable law. No moderation system is guaranteed to identify every unlawful or infringing item.
9. Third-Party Sources and Services
Users may choose external websites, themes, APIs, payment providers, authentication services, CDNs or other third-party resources. NEXGEN Gallery does not control their ownership, licensing, availability, security, content or terms. You are responsible for complying with applicable third-party terms and rights.
10. Plans, Coins and Payments
Plans, coins and digital entitlements are governed by the pricing and inclusions shown at purchase and by the Refund Policy. Third-party payment processors may apply their own terms. Nothing in these Terms excludes statutory consumer rights that cannot legally be waived.
11. Disclaimer and Limitation of Liability
To the maximum extent permitted by applicable law, NEXGEN Gallery is not liable for a user's unlawful activity, crime, infringement, unauthorized copying, prohibited content, publication decision or misuse of the software; nor for indirect, incidental, special or consequential loss arising from user-supplied material, third-party sources or events outside reasonable control.
No clause excludes liability, duty or remedy to the extent exclusion is prohibited by applicable law. A disclaimer does not legalize unlawful conduct and does not prevent action required by a court, regulator or competent authority.
12. User Indemnity
To the extent permitted by applicable law, you agree to indemnify and hold harmless the operator of NEXGEN Gallery and its personnel from third-party claims, losses, liabilities, damages and reasonable costs arising from your unlawful use, infringement of third-party rights, breach of these Terms or content you upload, copy, generate, publish or distribute.
13. Indian Cyber Law and Applicable Law
Use of the service in India is subject to applicable Indian law, including the Information Technology Act, 2000 and rules made under it, the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 as amended from time to time where applicable, intellectual-property laws, criminal law, consumer law and applicable data-protection law.
Nothing in these Terms should be interpreted as contracting out of mandatory legal duties. Users remain independently responsible for determining laws applicable to their content, location and activities.
14. Suspension and Termination
We may restrict, suspend or terminate access for suspected unlawful activity, infringement, abuse, fraud, security risk, non-payment, violation of these Terms or where required by law. Serious matters may be escalated without prior notice where legally permitted.
15. Changes to These Terms
We may update these Terms when features, legal requirements or business practices change. The current version and effective date will be published here.
