1. NEXGEN Gallery Is a Technology Tool
The platform provides theme processing, WebCopy, personalization, preview, editing and related technology. It does not independently verify ownership, copyright status, legality or regulatory compliance of every source or output.
2. NSFW, Adult and Prohibited Content
Users must not use NEXGEN Gallery for unlawful NSFW, obscene, sexually exploitative, child sexual abuse or exploitation material, non-consensual intimate imagery, unlawful pornography or any other content prohibited by law.
If a user nevertheless misuses the software to create, copy, process, upload, host or publish prohibited material, responsibility for that user's conduct and content rests with that user to the maximum extent permitted by law. NEXGEN Gallery may remove, block or report content where required or permitted by law.
3. Crime and Illegal Activity
NEXGEN Gallery does not approve, encourage or assist unlawful activity. Users must not use the software for fraud, phishing, impersonation, malware, unauthorized access, deception, trafficking, unlawful gambling, money laundering, harassment or other criminal or illegal purposes.
To the maximum extent permitted by law, the operator is not responsible for an independent user's criminal or unlawful conduct merely because the user misused this general-purpose software. This disclaimer does not restrict lawful investigation, court orders, statutory duties or liability that cannot legally be excluded.
4. Copied Themes, WebCopy and Copyright
The ability to enter a URL, download website resources or import a theme does not mean the material is free to copy. NEXGEN Gallery does not grant copyright, trademark, design, patent or other intellectual-property rights in third-party material.
The user must obtain all necessary permissions or have another lawful basis before copying, uploading, converting, modifying, sharing, selling or publishing a third-party theme, website, logo, image, video, font, code or other protected material.
Users are responsible for infringement claims arising from themes or content they copied from another source or uploaded without adequate rights.
5. Mature User and Content Responsibility
The service is intended for adults aged 18 years or older. Users are expected to act lawfully and responsibly and are responsible for their own instructions, uploads, publications, client work and deployment decisions.
NEXGEN Gallery cannot guarantee that every user-supplied file or remote source is lawful, accurate, non-infringing or appropriate.
6. Smart Processing and Automated Output
Smart Processing, local processing, automated conversion, color/logo replacement and other automated features may make technical transformations. Their output is not a legal opinion, copyright clearance, regulatory approval or guarantee that publication is lawful. Users must review output before use.
7. Theme Compatibility and Production Use
Compatibility may vary because of third-party frameworks, APIs, proprietary code, remote assets, licensing restrictions or server-side functionality. A successful preview or conversion is not a guarantee of production readiness, security, accessibility, legal compliance or uninterrupted operation.
8. Third-Party Websites and Services
NEXGEN Gallery does not control external websites, source themes, APIs, authentication providers, payment gateways, CDNs or other independent services. Their content, rights, availability and policies remain their responsibility and may impose separate obligations on users.
9. Limitation of Responsibility
To the maximum extent permitted by applicable law, NEXGEN Gallery is not responsible for losses, claims or consequences caused by a user's unlawful content, infringement, unauthorized copying, criminal activity, publication choices, inaccurate business information, third-party services or misuse of generated/converted output.
Users should maintain appropriate backups and independently test themes before production deployment.
10. Mandatory Law Prevails
Nothing in this Disclaimer excludes or limits a statutory duty, consumer right, data-protection obligation, court order, regulatory requirement or liability that applicable law does not permit to be excluded. Where Indian cyber or other law requires action concerning content, records, notices or lawful orders, those requirements prevail over this Disclaimer.
